By accessing and using the Academy of Compliance platform, website, and services, you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not use our services. We reserve the right to modify these terms at any time. Your continued use constitutes acceptance of updated terms.

2. Service Description

Academy of Compliance provides online compliance training and certification programs designed for banking institutions, financial services firms, and corporate organizations. Our platform delivers:

• Structured e-learning modules on AML/KYC, GDPR, compliance risk management, and business ethics
• Interactive assessments and certification upon completion
• Progress tracking and reporting for organizational administrators
• Secure, encrypted platform for sensitive training data

3. User Accounts and Credentials

3.1 Account Registration

You are responsible for maintaining the confidentiality of your login credentials and password. You agree not to share your account with unauthorized individuals. Academy of Compliance is not responsible for unauthorized access to your account resulting from your negligence.

3.2 Accurate Information

You agree to provide accurate, current, and complete information during registration. You are responsible for updating your account information if it changes. Providing false information may result in account suspension or termination.

4. Acceptable Use Policy

You agree not to use our platform to:

• Violate any applicable laws or regulations
• Engage in fraudulent or deceptive practices
• Attempt to gain unauthorized access to platform systems
• Transmit malware, viruses, or harmful code
• Harass, abuse, or threaten other users
• Share content that violates intellectual property rights
• Circumvent security measures or authentication protocols

Violations may result in immediate account suspension and legal action.

5. Intellectual Property Rights

All course materials, videos, assessments, and content provided on the Academy of Compliance platform are the intellectual property of Academy of Compliance or licensed partners. You may not:

• Reproduce, distribute, or transmit course materials without permission
• Modify or create derivative works from our content
• Remove copyright, trademark, or proprietary notices
• Share login credentials to allow unauthorized access to content

Unauthorized use of our intellectual property is prohibited and may result in legal liability.

6. Training Certification and Assessment

6.1 Assessment Integrity

Users agree to complete assessments honestly and in accordance with their organization's policies. Cheating, plagiarism, or unauthorized collaboration is strictly prohibited. Academy of Compliance reserves the right to invalidate assessments suspected of misconduct.

6.2 Certificate Validity

Certificates issued upon course completion are valid for the period specified in the course materials (typically 1-3 years). Organizations are responsible for determining certification validity for their compliance requirements.

7. Limitation of Liability

Our total liability to you shall not exceed the amount you paid for the service in the 12 months preceding the claim.

8. Disclaimers

The platform is provided "as is" without warranties of any kind. Academy of Compliance disclaims all express and implied warranties, including but not limited to:

• Fitness for a particular purpose
• Merchant-ability or non-infringement
• Uninterrupted or error-free service
• Results from platform use

9. Payment and Billing

9.1 Fees and Charges

You agree to pay all fees quoted for training programs and services. Pricing is in EUR unless otherwise specified. Payment is due upon registration or according to the invoice terms provided.

9.2 Refund Policy

Refunds are available if requested within 14 days of purchase and before significant course progress (typically 25% of content completion). Refunds will not be issued for courses substantially completed. Custom training and organizational licenses are non-refundable.

9.3 Auto-Renewal

If you subscribe to recurring training programs, your subscription will automatically renew unless cancelled. You may cancel anytime through your account settings.

10. Data and Compliance

10.1 Compliance Records

Organizations using our platform acknowledge that completion certificates and assessment records constitute proof of training completion for regulatory compliance purposes. Academy of Compliance maintains secure records for audit purposes.

10.2 Data Handling

We comply with GDPR, data protection laws, and financial services regulations. Organizational managers have the right to access training records for their employees. See our Privacy Policy for detailed information.

11. Termination

Academy of Compliance may terminate or suspend your account and access immediately if you violate these terms or engage in prohibited conduct. Upon termination, your right to use the platform ceases immediately. Accrued fees remain due.

12. Indemnification

You agree to indemnify and hold harmless Academy of Compliance from any claims, damages, or legal fees arising from your violation of these terms, misuse of the platform, or violation of applicable laws.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Poland, without regard to conflicts of law principles. Any disputes shall be resolved through binding arbitration or in the courts of Poland.

14. Dispute Resolution

Before initiating legal proceedings, parties agree to attempt resolution through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration or mediation.

15. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
